During the 19th century, the law was expanded to include maps, charts, engravings, prints,\u00a0 musical compositions, dramatic works, photographs, paintings, drawings, and sculptures. Whether the use of copyrighted content is considered Fair Use is determined on a case by case basis.<\/p>\n<p>Four factors are used to analyze whether Fair Use applies. Do you own the copyright to your published articles (Answer: You may or may not depending on the contract you signed with the publisher). What options do authors have for retaining their copyright? We\u2019ll explore the above questions in this section.<\/p>\n<p><span style=\"text-decoration: underline\"><strong>Copyright holders retain 5 basic rights<\/strong><\/span><\/p>\n<ol>\n<li>Right to Reproduce<\/li>\n<li>Right to Prepare Derivative Works<\/li>\n<li>Right to Distribute<\/li>\n<li>Right to Display Publicly (related to artistic works)<\/li>\n<li>Right to Perform Publicly (related to musical or dramatic works)<\/li>\n<\/ol>\n<p><span style=\"text-decoration: underline\"><strong>What could you lose if you sign away your rights (e.g., to a publisher)?<\/strong><\/span><\/p>\n<p>You could lose the right to:<\/p>\n<ul>\n<li>Use your work in a course<\/li>\n<li>Place copies on print or electronic reserve<\/li>\n<li>Mount a copy on your web site<\/li>\n<li>Deposit a copy in your institutional repository<\/li>\n<li>Distribute a copy to colleagues<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">If you transfer your copyright to a publisher, your rights will be limited by the publisher\u2019s license that you signed and the principle of Fair Use when using your own work in the future. Traditionally, academic publishers have required that authors transfer copyright to them, but this standard is changing.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">More and more campuses are creating <\/span><a href=\"http:\/\/roarmap.eprints.org\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Open Access policies<\/span><\/a><span style=\"font-weight: 400\"> that require authors to retain some rights to their work. The assignment of non-exclusive rights to publishers is becoming much more common. Information on <\/span><a href=\"https:\/\/libguides.sjsu.edu\/SJSU_ScholarWorks\/open_access#s-lg-box-4634096\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Open Access at SJSU<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"text-decoration: underline\"><strong>So, what should I do?<\/strong><\/span><\/p>\n<p>A variety of tools are available to help you navigate and negotiate for keeping some of your rights. The\u00a0<a href=\"https:\/\/sparcopen.org\/our-work\/author-rights\/\" target=\"_blank\" rel=\"noopener\">Scholarly Publishing and Academic Resources Coalition (SPARC)<\/a> can walk you through the process of creating an\u00a0<a href=\"https:\/\/sparcopen.org\/our-work\/author-rights\/#addendum\" target=\"_blank\" rel=\"noopener\">Author Addendum<\/a>\u00a0to attach to a journal publisher\u2019s copyright agreement to ensure that you retain certain rights.
